Texting a Driver May Result in Liability: N.J. Appeals Court

A New Jersey appeals court last week held that someone who sends a text message to a driver—and knows or has special reason to know that the driver might be viewing the text message while behind the wheel—may be held liable for an accident that the driver gets into while reading the text. So reports the Los Angeles Times.

 

The court rendered the holding while finding in favor of 17-year-old Shannon Colonna in this specific case. Colonna was named as a defendant in a case brought by two motorcyclists who each lost their left leg in a collision with 18-year-old driver Kyle Best. Best received a text from Colonna immediately before the truck he was driving injured the motorcyclists.

 

The court decided in Colonna's favor, finding the plaintiffs hadn't presented sufficient evidence to prove that she knew Best was behind the wheel when she texted him.
