Disbarred Attorney to Get New Trial in Wake of Judge’s Testimony

An appeals court in Texas ruled a disbarred attorney, Mark Cantu, deserves a new trial after a court erroneously allowed a bankruptcy judge to testify about purported misconduct. So reports ABA Journal

Cantu’s disbarment was overturned by a 2-1 vote of the Thirteenth Court of Appeals in Corpus Christi. Cantu was disbarred for allegedly failing to disclose “significant assets” during his bankruptcy proceedings.

U.S. Bankruptcy Judge Marvin Isgur testified he had negative feelings toward Cantu. A dissenting judge said Isgur’s observations served as the “basis for the allegations, and his testimony was needed to help jurors decide whether Cantu violated disciplinary rules,’ according to information from the story.
