They’re asking New York's highest court to review a lower court's dismissal of their case, according to an article in the National Law Journal.

The case is among the first of 15 fraud actions against U.S. law schools pending around the country. So far, similar cases against law schools have been dismissed in Illinois, but have survived initial motions to dismiss in California.

Lawyers for the former New York Law School students argue the New York Court of Appeal should weigh in on the case for the sake of potential future litigants and law schools, which "need to know what they can and cannot do in terms of marketing in New York."
