The woman, 70-year-old retired schoolteacher Rachel Smith, continued renting out two rooms in her home for $80 each per night after she’d received a city penalty notice and order to stop. Because Smith used her primary residence to provide lodging for paying guests for less than 30 days at a time, she was violating the city's bed and breakfast code, which requires a conditional use permit.
Smith denied that her arrangement qualified as a bed and breakfast and continued to rent her rooms until her attorney advised her to stop.
