Evan Mandery's new book, A Wild Justice, chronicles the many times that the U.S. Supreme Court came close to declaring the death penalty unconstitutional. So reports an article from Slate.

The book's description of events—including the 1963 circulation of an anti-death-penalty memo written by then-Supreme Court clerk Alan Dershowitz and the cataclysmic 1972 decision by then-Chief Justice Warren Burger to change his vote in Furman v.
