Initially, a lower court threw the case out as the litigants were unable to prove they were harmed by the President’s actions. However, a three-judge panel of the U.S. Circuit Court of Appeals reversed that decision, although it did not directly address whether or not the President broke the law. The case was brought by Citizens for Responsibility and Ethics in Washington and rests on the U.S. Constitution’s “emoluments” provisions.
