Immigration Agency Acting Director Lacks Legal Authority: Advocates

Democracy Forward and the Catholic Legal Immigration Network, Inc. have filed a federal lawsuit challenging the authority of acting Citizenship and Immigration Services Director Ken Cuccinelli. So reports CNN.

The lawsuit argues Cuccinelli does not have the authority to issue "asylum directives" and does not have the authority to serve in his current position because he does not meet the requirements laid out in the Constitution and the Federal Vacancies Reform Act. The agency did not have a comment in response to the lawsuit.
