Court: Re-Sellers of Digital Content Need Permission from Copyrighters

In a case watched closely by many members of the music and movie industries, a federal district court on March 30 held that the “first sale doctrine,” which allows consumers to legally resell CDs and DVDs, doesn’t apply to digital media.

So reports Billboard.

 

The court issued the holding in the course of finding that ReDigi Inc., a company that sought to build a marketplace for consumers to sell “used” digital songs, violated Capitol Records’ copyrights.

The decision “doesn’t necessarily spell doom for digital resale models,” but it does make it clear that the sellers and services facilitating the re-sales need to get permission from the original copyright holders.
