The state’s three-drug method was planned for use in the now delayed execution of Ronald Phillip. The judge ruled the sedative midazolam would not pass a constitutional ban on a drug having “substantial risk of serious harm." The second and third drugs were also barred. The state has appealed to the 6th U.S. Circuit Court of Appeals in Cincinnati.
