Judge: 2020 Census Citizenship Question ‘Arbitrary And Capricious’

Judge Jesse M. Furman ruled a potential census question asking about citizenship would likely pass constitutional muster, but is still in violation of the law. So reports the Associated Press.

Furman said Commerce Secretary Wilbur Ross exhibited "arbitrary and capricious" behavior when crafting it and, as such, blocked the question. Ross was said to have violated a law requiring three year’s notice be given to Congress before adding a citizenship question.

Considering other cases dealing with the item, the U.S. Supreme Court may have the final say.
